We would like to inform you that by using the website available at borvilag.hu, you, as a consumer, declare that you know and accept the following, the Civil Code. (Act V of 2013) 6: 77-6: 81. If you wish to be a customer or an active user of the possibilities offered by our Webshop, please read our General Terms and Conditions carefully and use our services only if you agree with all its points and consider them binding on you.

This document is concluded in electronic form only. The contract regulated by the following conditions is governed by Art. shall be deemed to be a contract concluded in absentia.

2. Products and services available at the webshop

Quality wines, wine accessories, quality sweets. For end users only.
(From an administrative point of view, the products offered on the BorVilág webshop cannot be sold to resellers in accordance with the provisions of the Excise Duty Act.

3. Ordering process

Registration/login

If you want to place an order and purchase a product, you must also provide the information required for the first purchase, including your name, billing and shipping information, email address, phone number, and password to log in later. It is also necessary to accept the registration conditions before finalizing the registration. The registration will be confirmed by e-mail. The customer is obliged to keep the password provided confidential by him in accordance with the Privacy Policy. If, during the identification, the data of the customer has been obtained by an unauthorized third party after the correct entry of the customer's unique ID and password, the Data Controller shall not be liable for any resulting damages or inconveniences. By entering their e-mail address, users consent to the operator / service provider sending a technical message to them. The registered data is deleted from the system by the Data Controller upon request. For security reasons, a deletion request will only be valid if the user confirms the deletion request by e-mail, so that someone cannot intentionally or mistakenly delete someone else from the registration database. Registration is identified by an email address, so an email address can only be registered once.
There are no obligations to register.
Before ordering, you must log in after registration.
You can log in using the Login menu item. Enter your registered email address and password here, then press the sign in button. If the login is successful, this window will display your user account and an exit button that will allow you to leave the store. If you are a registered customer but have forgotten your password, use the forgotten password button in the Login menu. If you enter your registered email address here, your password will be emailed to you.
After logging in, you can set up and change your data in the user account (change password, contact data, billing data, shipping data), view your previous orders.

 

Selecting a product
The customer has the opportunity to choose or order from the products of the store. The customer can click on the selected product to view its detailed description. If you intend to buy, you want to add the product you want to buy to a virtual cart by clicking the "Add to Cart" button. By clicking on the "View" button in the Cart, you will find the products placed in the cart during the purchase, as well as the total amount of the invoice and the shipping cost. Here they can check the correctness of their order, especially the prices and quantities, which they can change and improve as required. Your cart will automatically calculate the total amount of your order.

Finalizing the order
If you think the quantity of products in your cart is correct, you have checked the total amount and decided that you want to buy them, simply click on the "Checkout" button. You can buy in our store without registration, so you can choose from three options:
• whether you want to log in as an already registered customer
• you want to register as a new customer
• You may want to purchase without registering
If you have previously purchased from our store, please enter the email address and password you provided during your previous registration. If you want to register as a new customer, enter your purchase information, which will be stored by the system and you will only need to log in the next time you make a purchase. For purchases without registration, enter your billing and shipping address.
In the next step, select the appropriate shipping method:
• Home delivery (with DPD courier service)
You'll then need to choose a payment method that's right for you:

 

  • With Barion using own credit/debit card or Barion wallet
  • Bank transfer
  • Cash on delivery: with cash at the DPD carrier upon receiving the order
Possibility to correct data entry errors
You have the option of correcting data entry errors before pressing the "Order" button.
 
If you agree with the contents of the order, click the "Order" button to submit the order.

 

Prices
Our prices are the list prices valid at the time of ordering, which can be found in the online store next to the products. Prices are gross prices, VAT included, however, these prices do not include shipping costs. The shipping cost can be found during the checkout process before the order is finalized and in the Purchase Conditions. If there is an error or defect in the products or prices in the web store, we reserve the right to make corrections. In this case, we will inform the customer of the new data immediately after recognizing or modifying the error. The buyer can then confirm the order once again or there is a possibility for either party to withdraw from the contract.


Processing an order
Orders are processed on business days. It is also possible to place an order outside of the times marked as order processing, but if it is made after the end of business hours, the order will only be processed on the following business day. The deadline for fulfillment of the accepted order is 2 working days from the confirmation.

 

Confirmation
We will send you an email with feedback on each order. This means that after you place your order, you will receive an automatic email about the receipt of your order and (later) one about your expected delivery date. In the case of a telephone consultation, call customer service or any of the telephone numbers in the email.

 

Dispatching
Shipments are delivered by DPD courier service. The delivery time of the product will be described by the webshop during the checkout process and will also be included in the confirmation email. You can arrange the delivery time by phone at the confirmation e-mail.

 

Delivery fee:
Our delivery fees are calculated by the system depending on the zone fees and package sizes determined by the DPD Courier Service. For orders over HUF 20.000 we do not charge delivery fee. We do not currently accept deliveries outside Hungary.

 

Withdrawal from delivery
If the webshop fails to fulfill its obligations under the contract because it does not have the goods specified in the contract at its disposal or is unable to provide the ordered service, it is obliged to inform the customer thereof. The online store does not enter into contracts with minors. By accepting the commercial conditions, the customer declares that he is of legal age.


Information about contracting

The language of concluding the contract is Hungarian, and is considered to be concluded electronically. The concluded contract will be available afterwards.

Right of withdrawal / Return guarantee

According to the provisions of the Government Decree 45/2014 on contracts concluded in absentia the provisions of this section shall apply only in the case of a consumer who qualifies as a customer. Within 14 working days from the receipt of the ordered product, the consumer may withdraw from the contract without giving reasons and return the ordered technical products in unopened packaging. If the consumer exercises his right of withdrawal, he is obliged to inform the operator in a clear written statement (by registered return receipt or by e-mail). The operator shall confirm the withdrawal to the consumer immediately upon receipt. If the consumer withdraws, he must return the ordered product to the operator within 14 days of the notification of his withdrawal. The cost of return is borne by the consumer. In addition, no other costs are borne by the customer. However, the seller may claim compensation for damage resulting from the improper use of the goods. If the goods returned under the right of withdrawal are not in perfect, resellable condition, the customer is obliged to pay damages if the deterioration, destruction or other impossibility of returning the goods was caused intentionally or through negligence.

If the product is found to be damaged during the opening in the presence of the person delivering it (postal delivery, courier) and the damage occurred before the receipt of the goods, we will ensure the return of the product and the cancellation of the sale immediately. Any damage or lack of content during the delivery of the consignment must be included in the factual report between the transferor and the transferee! We cannot be held responsible for any subsequent lack of content or damage!

If the consumer exercises the right of withdrawal, the operator shall reimburse the consumer for the payments made, including delivery charges, within 14 days of receipt of the declaration to that effect. An exception to this is if the consumer has chosen a mode of transport which involves additional costs and which is different from normal transport. The service provider does not have to fulfill his obligation to repay until he has received the returned product or received a creditworthy certificate from the consumer about the return of the product. In the event of a discrepancy between the two dates, the operator must take the earlier date into account.

 

The operator may demand compensation from the consumer for material damage resulting from improper use. Therefore, pay special attention to the intended use of the product, as the consumer will be liable for damages resulting from improper use.
Upon receipt of the package by our company, the unpacking of the package and the examination of the returned product will be recorded with a video camera. This is to avoid any possible future misunderstandings. (for example, that the returned product was damaged or incomplete)
 
For drinks, gourmet foods, chocolate, truffles.

 

The Buyer may not exercise his right of withdrawal if he has opened the packaging of the ordered food-based product (eg chocolate, cakes, wine). Furthermore, food products delivered and received cannot be returned due to hygiene and health reasons, for which the consumer does not have the right of withdrawal (Government Decree 17/1999 (II. 5.)).

Modify or cancel an order

According to the law 2001 CVIII., when placing an order, the software of the seller's web store sends a notification to the buyer immediately about the fact that the order has been placed. This notice does not constitute a contract between the seller and the buyer! It only indicates to the buyer that your order request has been registered and forwarded by our system to the seller's competent employee. The contract is concluded between the Buyer and the operator when the order is confirmed. The Operator reserves the right to reject the Order submitted by the Customer or to confirm less than the quantity of the products included in it - depending on the stock.
 
If this is not received by the buyer within 2 working days, the buyer's bidding obligations will be terminated.
The consumer, who qualifies as a consumer, may also exercise his right of withdrawal between the date of conclusion of the contract and the date of receipt of the product.
Subsequent changes to the order can only be made in writing by e-mail.
The Operator may, without notifying the Customer at the same time, cancel the Customer's order without legal consequences in the following cases:
 - if the Customer has indicated an online payment method and the financial institution issuing the card does not allow the transaction;
 - if the Buyer has indicated an online payment method and the online payment partner is unable to validate the transaction;
 - if the data provided by the Buyer does not cover the reality, is incomplete or does not allow the order to be fulfilled.

 

4. Complaints

The operator is obliged to keep a report on the complaint in the place indicated in the data of the operator and to keep the complaint for five years from the date of collection, together with the response to it. The operator shall investigate the complaint received within 30 days of its receipt and provide a substantive response. If the operator responds to the complaint, he must give reasons in writing. Disputes arising from the contract concluded with the operator may be settled primarily amicably, by agreement between the parties or before the competent consumer protection authority according to the place of residence of the consumer. If these do not lead to a result, the parties will have to go to court.

11. Data managemet

The operator manages the personal data provided during the use of the web store confidentially and does not disclose it to an external third party, unless it is necessary for the delivery of the order to its subcontractor (eg courier service). All details related to data management are included in the Data Management Information available to everyone on the website.

15. Miscellaneous

- The validity of the wholesale license number is the responsibility of the customer.

- In matters not regulated in these general terms and conditions, the Civil Code (Act V of 2013), and the provisions of a Government Decree 45/2014 on distance contracts concluded in absentia for consumer contracts. shall apply.
